How we handle a Chapter 7 Bankruptcy Process:
After our initial consultation to determine whether you
qualify for a Chapter 7 Bankruptcy, attorney Darvish will provide you with a
questionnaire to be completed by you. It is important to complete this
questionnaire as completely as possible. The vital information you provide on
the questionnaire is used to prepare the bankruptcy petition.
You will also be required to submit your past two years of
your tax returns in addition to your past 3 months of paystubs if you have been
employed. If you have not been employed during this time or are considered
an independent contractor, no paystubs are required.
Once you have completed the questionnaire, have provided
your tax returns and your paystubs (if needed), our office will begin working on
your Chapter 7 Bankruptcy Petition.
During this time, you will also be required to complete a
pre-bankruptcy debt management course. Mr. Darvish will suggest websites
to visit to complete this course. The course is generally a 90 minute
program. At the end of the course, the counseling center will provide a
certification of completion, which will be used to file your bankruptcy
petition.
Once our office has completed the bankruptcy petition, we
will provide you a copy of it for review. If the petition is accurate, we
will obtain signatures from you so that we may file it with the bankruptcy
court. We generally file bankruptcy petitions in Los Angeles, San
Bernardino, Orange County, San Fernando depending on where you reside.
After we file your petition, you
will be provided a case number, which you may share with your creditors should
they continue to call you. The bankruptcy court shall send notices
regarding the bankruptcy petition to all your creditors. However, if they
continue to contact you, you may provide them with the case number. By
law, they should stop contacting you.
After filing, you will also be
required to take an additional course call the "Personal Financial Management"
course. Again, they will provide a certification, which shall be filed
with the bankruptcy court.
Approximately 20 to 40 days after
filing your petition, you will attend what's called a "Creditor's Meeting".
Either Mr. Darvish or one of the firms attorneys will be representing you at the
Creditor's meeting. There, the bankruptcy court will question you
regarding your petition and your financial situation. This questioning
shall be done under oath. The questioning lasts anywhere from 30 seconds
long to about 5 minutes long.

that is financed, there are additional steps that are required to be taken.
